With the approach of the 2022 Winter Olympics, there have been reports in Beijing of a few logo infringement cases. Beijing Administration for Industry and Commerce (BAIC) investigated two such cases, issuing fines for a total of 3.72 million Yuan.
Guo Xiao Yang, the leader of the BAIC Inspection Team brought an action against one of these companies. In this case, Beijing Jiadejiye Investment Advisory Co., Ltd were selling commemorative pens and seals made of Hetian jade on the Internet and over the phone. "BEIJING Applicant City 2022 Winter" was stamped on the top of the pen and the cap. The Hetian Jade seal was engraved with "Beijing 2022 Winter". The investigation result showed that those products were manufactured without the permission of the logo owner. Since the logo was used for commercial activities, the manufacturers violated the relevant laws and regulations.
How should such cases be punished? Guo Xiaoyang said the punishment was generally based on the type of infringement and the amount of money involved in the case. In both cases the fines were over 590,000 Yuan. In another case, Zhongshisoucang (Beijing) International Collection Limited was fined 3.13 million yuan.
