The People’s Court of Beijing Haidian Division revealed that the Sina Corporation was unsatisfied with PPTV using the special reports of “Beyond Champions” for promotional purposes. The programme was produced by Sina to present the highlights of the Olympics. Now, Sina has filed an unfair competition claim against PPTV for compensation of RMB 100K.
Sina alleged that, during the 2016 Olympics, under the theme of “Beyond Champions,” it presented photos and original texts about the highlights of the Olympics, and published special exclusive reports on dozens of hot issues during the Olympics. Along with its classic Olympic business brand, this became one of its most important promotional projects during the Olympics, and created a very strong corresponding association with the company.
On August 19, 2016, during the semi-finals of the Women’s Volleyball Championship at the Rio Olympics, without getting Sina’s authorization, PPTV split the theme image of “Beyond Champions” into two. They then put them in prominent positions on the top of its first page; directly used one of Sina’s original photos as the album image for the 13th edition of comprehensive Olympic reports. They also copied Sina’s original slogan “Beyond Champions” to another image for a themed promotion.
Sina believes that PPTV has seriously violated Sina’s legal rights, and the loss to Sina and the illicit profit PPTV obtained are above average. Sina has sued to get PPTV to make up for the effects of their actions and compensate Sina for the economic loss of RMB 100K.
